Terms of service
Effective September 30, 2026. These terms cover your use of Tuck.
Service
Tuck is a private family memory keeper operated by 2618991 Ontario Inc., an Ontario corporation. In these terms, “Tuck,” “we,” and “us” refer to 2618991 Ontario Inc. when it operates the Tuck service. Parents and trusted contributors can send messages, photos, and MMS voice notes so Tuck can preserve, organize, search, and return family memories. By using Tuck, you agree to these terms and to our Privacy Policy.
Who may use Tuck
You must be at least 18 years old and able to enter a contract to use Tuck. Tuck is intended for adults who are parents, guardians, family members, caregivers, or authorized contributors to a private family memory record. A family organizer is responsible for inviting only people who should have access to that family's memories, and for the activity on the family's account.
Content about others, children, and recordings
Much of what families send to Tuck is about other people, especially children. By sending content, you confirm that you are a parent, guardian, or authorized caregiver of any child you record or describe, and that you have the right to share information about any other person you include. You are responsible for the choices of contributors you invite.
When you send an MMS voice note, Tuck stores and transcribes the audio to capture the memory. If other people can be heard, you are responsible for any consent their recording requires under the laws that apply to you. Do not record anyone where you are not permitted to.
Family content
Families keep ownership of the messages, photos, voice notes, names, stories, and memories they send to Tuck. By sending content to Tuck, you grant Tuck a limited license to process, store, transcribe, summarize, organize, illustrate, and return that content for the sole purpose of providing the service to your family. Tuck does not sell family content and does not use it to train third-party AI models.
Historical voice_call and voicemail captures, where they exist from an earlier product version, remain family content under these terms and are included in the same export and deletion-request process as other captures.
AI and original wording
Tuck uses AI and is designed to preserve original wording separately from summaries and tags. AI-generated summaries, tags, illustrations, and replies may be wrong, incomplete, or less precise than the original family content, and should not be relied on as a factual record or as professional advice. You are responsible for any decisions you make based on Tuck's output.
Messaging
Using Tuck may involve the Tuck Moments recurring SMS and MMS program and related carrier or provider services. Tuck does not offer live inbound or outbound phone calls. By providing your mobile number and opting in, you consent to receive recurring automated messages from Tuck Moments; consent is not a condition of any purchase. Message frequency varies, and message and data rates may apply. Messages come from +1 888-655-9170 in the United States and Canada. You can opt out of text messages by replying STOP, resume by replying START where supported, or reply HELP for help. For additional support, email tuck@tuckmoments.com. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for information about how messaging data is handled.
Referral sender credit
A sender reward applies only when the current referral offer shows it. Under the approved $50 offer, an eligible sender earns C$50 or US$50 in the sender’s Tuck billing currency after the referred family makes its first confirmed paid continuation and completes a 30-day hold. A trial, free month, failed payment, refund, dispute, or self-referral does not qualify. The credit applies to future Tuck invoices in the same currency, carries forward, and is not cash or transferable. If the payment is later refunded or disputed, Tuck may review the credit; Tuck does not automatically charge the sender. The referred family’s identity, messages, and payment activity remain private. Already-issued credit stays available if new rewards pause.
Give Tuck gifts
Optional address search uses Google Maps. If you use it, the Google Maps Additional Terms of Service apply to that search. You can enter your shipping address without address search.
Give Tuck is a prepaid gift for one family. The buyer chooses one of three books: Softcover, Hardcover, or Layflat Hardcover. One payment includes 12 months of service and one book of that type with up to 80 interior pages and shipping. The recipient chooses the memories and approves the book before printing. The service term starts only when the recipient verifies their phone and activates the gift. It does not start at purchase, email delivery, or a link visit.
The recipient does not need a card. A gift is not a recurring subscription. It does not renew and does not authorize another charge to either the buyer or recipient. To continue after the gift, the recipient must make a separate purchase after seeing its current price and terms. The buyer does not gain family membership or access to the family’s memories. When gift checkout says the gift includes the family’s weekly chapter for the buyer, the buyer receives that chapter once the family activates the gift and the buyer confirms their email. It continues until a family owner or admin removes them or the buyer unsubscribes.
The buyer can request a full refund before activation or within 14 days after activation. Contact tuck@tuckmoments.com with the order reference. Refunds return to the original payment method. A refunded gift cannot be redeemed. Anything already printed is the recipient’s to keep.
An unused gift does not expire or lose its value. A secure link can expire; contact Tuck for a replacement. Expiration of a link does not cancel the unused gift. An earned book remains available under its terms after service ends. A gift does not combine automatically with an active subscription, another gift, or referral credit. Contact us before buying for an existing customer so we can check the current plan and book rights. We do not overwrite an existing family or active subscription.
Existing gifts: September 2026 annual offer
Gifts recorded under offer give-tuck-2026-09-annual-only keep their original terms, even if activated after the book choices begin. They include 12 months of service and one annual 11.7×8.3 inch layflat hardcover with up to 120 interior pages and shipping. A full refund is available before activation or within 45 days after activation. All other gift terms above apply.
Existing gifts: original September 2026 offer
Gifts recorded under offer give-tuck-2026-09 keep their original terms, even if paid or activated after the new offer begins. They include an early edition of the family book after the first 10 moments, with no deadline to earn it, plus the annual hardcover and shipping. The family approves each book before printing. A full refund is available before activation or within 45 days after activation. If the recipient sends the first 10 moments within 30 days after activation, the refund window stays open until at least 7 days after the early edition is delivered. All other gift terms above apply. An email reissue or a later activation does not change the offer.
The price and currency depend on the recipient’s service region, Canada or the United States. Any applicable tax is shown before payment. Gift email delivery follows confirmed payment. You can include an optional personal message in the gift email. For gifts bought under offer give-tuck-2026-10-scheduled, choose Send now or a future date, time, and recipient time zone. Invitations send from 8 a.m. to before 9 p.m. in that zone. The time is a send schedule, not a guarantee of inbox arrival. You can change it from your private receipt until sending starts. If payment confirms after a chosen date, the invitation moves to the next local morning. Older gifts keep their immediate-send terms. A printable card is available after confirmed payment. The book follows the recipient’s year and their approval; it is not a completed book for Christmas. Contact us if an invitation is sent to the wrong address or cannot be delivered. Your purchase does not enroll the recipient in marketing emails or recurring texts. The recipient makes their own choices during setup.
Subscriptions and billing
Book plans
New subscriptions choose one of three yearly plans: Softcover, Hardcover, or Layflat Hardcover. Every plan includes the same Tuck service for 12 months and one book of the type you chose, with up to 80 interior pages and shipping. The plan, price, currency, and first charge date are shown before Checkout.
You add a payment method when you sign up and pay nothing that day. Your first 14 days are a trial, limited to one per family. We email you a reminder before the trial ends. If you cancel before the trial ends, you are not charged. Otherwise, your plan’s yearly price, plus any applicable taxes, is charged when the trial ends, and your service year starts then.
A successful yearly payment earns one book credit for your plan’s book. An earned credit does not expire and can be used when you are ready. You choose the memories and approve the proof before printing. Before your book prints, you can move to a higher plan for that year by paying the difference between the two plan prices.
Unless you cancel, your plan renews each year and your payment method is charged the then-current price for your plan, plus any applicable taxes. You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current paid year. After the trial, except where required by law, payments are non-refundable and partial periods are not pro-rated. Anything already printed is yours to keep. We will give advance notice of any price change, and continued use after a change means you accept the new price. Payments are handled by a third-party payment processor; Tuck does not store full card numbers.
Earlier subscriptions
Subscriptions that started before the book plans keep the prices, rights, trial terms, guarantees, and earned books they agreed to. The rules below apply only to those subscriptions.
For payment-choice subscriptions, the charge, currency, payment interval, renewal terms, and book-credit threshold are shown before Checkout. Each option includes the same Tuck service. A successful annual payment earns one book credit. Monthly and weekly payments earn one credit after 12 paid monthly or 52 paid weekly service periods. Paid progress stays through gaps. Trial periods, failed payments, and fully refunded payments do not count. Partial refunds, disputes, mixed payment schedules, and conversion after a gap require review before book credit is confirmed. An earned credit does not expire and can be used when you are ready. One credit covers one 11.7×8.3 in layflat hardcover with up to 120 interior pages and shipping. You choose the memories and approve the proof before printing. Payment frequency does not set print frequency.
Digital, Annual Book, and Family subscriptions keep their agreed prices, rights, trial terms, guarantees, and earned books, and the following annual subscription rules apply to them. Digital includes the private digital annual book. Annual Book includes one 11×8 hardcover up to 120 pages, and Family includes two identical hardcovers. You may be asked to provide a payment method up front, and your subscription begins when checkout completes.
For these earlier subscriptions: unless you cancel, your subscription automatically renews each year and your payment method is charged the then-current price, plus any applicable taxes, until you cancel. You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current paid period. Physical books are produced only after you review and approve the proof. If a book included with an Annual Book or Family plan is still unused at renewal, that book remains available and the next family year renews as Digital at the then-current Digital price. If the included book has been used, the selected book plan renews normally unless you change or cancel it. These earlier subscriptions have a 45-day money-back guarantee: request it in one text (REFUND) within 45 days of your first payment, and we will cancel the subscription and refund every payment you have made, in full. If you sent your first 10 moments within 30 days of your first payment, the window stays open until at least 7 days after your early edition is delivered. Anything already printed is yours to keep. After that window, except where required by law, payments are non-refundable and partial periods are not pro-rated. We will give advance notice of any price change, and continued use after a change means you accept the new price. Some families may be given complimentary or founding access at our discretion. Payments are handled by a third-party payment processor; Tuck does not store full card numbers.
Book approval and changes
No book prints until the family owner approves it. Before printing, we send you the finished book to review. You can approve it as is or leave notes asking for changes, and we show you the changes we plan to make before we make them. Each book includes two rounds of notes. Corrections to names, dates, and who said what do not count toward those rounds. We do not reword a child’s original words. Photos and moments sent before your first round of notes can be added to the book; later ones are kept for your next book. Approval is final: we print the version you approve. If a book arrives damaged or with a printing defect, tell us within 10 days of delivery and we will replace it at no cost. The content of an approved book, including spelling, is not a printing defect.
Fair use
Tuck is meant for ordinary, personal use by a single family. It is not for commercial, bulk, automated, or resale use, and it is not a general-purpose messaging, storage, or telephony service. To keep Tuck reliable and affordable for everyone, and because messaging and media processing carry real per-use costs, we may set reasonable limits and monitor for atypical usage. If usage is extreme, automated, or appears abusive, we may rate-limit, throttle, pause, or contact the family about that usage, and in clear cases of abuse we may suspend the account.
Acceptable use
Do not use Tuck to send unlawful, harmful, or infringing content, to record or share information about people you are not entitled to, to impersonate someone, to access another family's memories without permission, to interfere with or reverse-engineer the service, or to abuse messaging, email, media-processing, or AI systems.
Not for emergencies
Tuck is not an emergency service and may not deliver or respond to messages in real time. Do not use Tuck to report emergencies or to seek medical, legal, safety, or other urgent help. In an emergency, contact your local emergency number (such as 911).
Availability and your own backups
Tuck is provided on an as-available basis and may be unavailable during maintenance, vendor outages, updates, rate limits, or service failures. We may add, change, or remove features over time. Memories should not be treated as the only copy of irreplaceable family media. Please keep your own backups of anything you cannot afford to lose.
Disclaimers
Tuck is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that Tuck will be uninterrupted, error-free, secure, or that memories or media will always be preserved, available, or accurate.
Limitation of liability
To the fullest extent permitted by law, 2618991 Ontario Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, memories, media, profits, or goodwill, arising from or related to your use of Tuck. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid Tuck in the twelve months before the claim, or fifty U.S. dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Suspension and termination
You can stop using Tuck at any time, and you can cancel a subscription as described above. We may suspend or end access for abuse, non-payment, security or legal reasons, or if we discontinue the service. We aim to give reasonable notice and a path to export where practical.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts of Ontario, Canada will have jurisdiction over any dispute relating to Tuck or these terms, though either party may seek injunctive relief in any court of competent jurisdiction. Nothing in these terms limits any mandatory consumer-protection rights you have under the laws of the place where you live.
Changes
We may update these terms from time to time. Material changes will be posted on this page with an updated effective date.
